Sažetak
The article provides a comparison of Croatian's former and current divorce procedures in order to explain why agreements on parental responsibility are increasing under the new Family Act 2015. The article presents the new approach, following the reforms to divorce procedure by the FA 2015, which gives parents the responsibility of organizing family life after divorce, but with the support and assistance of the state. It sets out and explains the first study of the reformed divorce process. The study compared the divorce procedure under the FA 2003 with the procedure under the FA 2015, concluding that parents are more likely to make an agreement on parental responsibility (leading to divorce by mutual consent)if they have an obligation to participate in an appropriate supportive process before initiating court proceedings.
