Sažetak
The Italian discussion that preceded the introduction of the penal code Zanardelli is being analyzed with a particular attention in regards to the problems of imputability and psychiatric seclusion. The philosophical concepts adopted by the two schools present in the discussion, the positivist and the classical school of jurisprudence, are scrutinized and compared. A particular emphasis has been given to the comparison between the criminologist and psychiatrist theory of the epoch and the actual psychiatrist's practice in the Trieste asylum "Andrea Galatti".
