Sažetak
This work analyses the 19th century debate that emerged in Italy between the classical school of jurisprudence and the positivistic school of criminal anthropology regarding the justification of psychiatric seclusion up to the formulation of the penal code Zanardelli (1889) and the law on asylums (1904/1909) as well as it application in practice in the asylum “Andrea di Sergio Galatti”, Trieste. The work is focused on patients diagnosed with psychopathy related mental illnesses and the criterions that were used to justify their seclusion.
