Concept of identifiability in European data protection law
Analysis shows that the GDPR follows earlier CJEU case law (based on the Data Protection Directive), on digital identifiers as personal data. It also explicitly broadens the concept in particular as regards identifability in networked presence. At CoE level the GDPR’s approach is evidently followed in interpretations as set in draft explanatory report to draft modernized Convention 108, however, core definition of personal data in text of draft Convention remains „dry” and thus subject to different standards and interpretations (globally - subject to aspired global accession)
