La definizione di giustizia secondo il diritto romano nel capitolare di Momiano
‘Il Capitolare di Momiano/Momjanski kapitular’ or the Capitulary of Momiano (also defined as the Codex of Momiano or the Statute of Momiano) is a document that codifies the municipal laws of Momjan/Momiano from 1521. The Capitulary represents a typical codification of the totality of medieval law, especially of laws pertaining to Istrian communities, preceded by two legal phases of the community development in Momjan/Momiano: that of the Habsburg rule (up until 1508) and that of the rule of Pirano/Piran (from 1508 onwards). Some important concepts of the Capitulary are clearly rooted in Roman Law, on the one hand, and an understanding of the notions of law and justice based on Canon Law, on the other hand. The paper analyses the influence of Roman Law on the definition of law found in the beginning of the Capitulary (‘proemio’), which is written in a vulgar variety of Latin, as opposed to other parts of the Capitulary
