Refocusing Legal Translation as Transcultural Communication: A Battle Over Concepts

Concentrating on the link between law, language and culture, the authors propose ways to overcome the interdisciplinary challenges posed by legal translation in practice. This is illustrated on the example of a recent legal case dubbed the ‘high-heeled dispute’ brought by the fashion designer Loubutin against Yves Saint Laurent in 2011 and 2012. The case was overshadowed by high translation costs, since it was adjudicated before a U.S. court, wherefore an immense bulk of documents had to be translated from French into English. In addition to the mere quantity, the translator's job was exacerbated by the incongruent legal systems of the states in question. Departing from this background, the authors call for a shift of focus in legal translation, while proposing practical guidelines for legal translators.
