Right to Access to Information
The author defines the right to access to information, its origin and evolution and analyzes the constitutions and case law in 56 countries. The criteria for the selection were the following: countries with the largest population, countries where the right to access to information originated, countries whose constitutions contain provisions granting the right to access to information, countries where this right has been the subject of judicial interpretation by the highest courts, and countries whose constitutions do not contain such provisions, but have enacted the right to information legislation. The comparative analysis of 56 countries shows that the vast majority have adopted constitutions in which the access to information is guaranteed or that the highest courts have ruled in favour of recognizing the constitutional right to access to information.
