Social Security and Health Care Abroad
Increased involvement of EU law in the area of patient mobility between the Member States is one of the most debated issues of the European integration. The crucial point is however how to make that health care provided outside the country of social protection (national health system or social insurance) can be treated in the same way as health care provided in the country of social protection. What has been lacking so far is a comparative analysis of national social security law in several relevant states to determine the concrete repercussions of the freedom to receive health services abroad guaranteed by the EU law on national rules regulating social security coverage of medical treatment abroad. The proposed dissertation seeks to determine to what extent the Member States of the EU can limit access to medical treatment abroad by way of limiting social coverage of the treatment. It employs the doctrinal method to investigate the relevant EU rules and the comparative method to compare the national rules on social security with the EU legal framework. Finally, it aims to find a balance between the national social security objectives and the free movement of patients as defined by the EU law.
