International Conference 35 Years of CISG: Present Experiences and Future Challenges

The book contains materials presented at the “35 Years of CISG – Present Experiences and Future Challenges” International Conference held on the 1st and 2nd December 2015, in Zagreb, Croatia and co-organized by the University of Zagreb, Faculty of Law and the United Nations Commission on International Trade Law (UNCITRAL). The Conference was, after conferences in Basel, Washington, Rio de Janeiro and Incheon, the last regional conference in the series, organized following the UNCITRAL decision to co-organize or support conferences in 2015 in each of the five UN regional groups, in order to celebrate the 35th Anniversary of the United Nations Convention on Contracts for the International Sale of goods (“CISG”). The CISG Zagreb Conference 2015 represented the Eastern European UN regional group. In addressing Present Experiences, the Conference focused on the experiences of Central East and South East European countries in the use of the CISG in legal practice. For that purpose, the organizers drafted a questionnaire on selected CISG topics, i.e. personal scope of application, substantive scope of application, reservations and specific rights and obligations arising out of contracts of sale etc. Fifteen national reporters discussed their reports at the Conference. To provide broader a context, experiences of three countries outside of the CEE/SEE region, Italy, Germany, The Netherlands and Switzerland were also reported. Most of the national reports, in their updated versions, are published in the book. In the part of the Conference dedicated to Future Challenges, the Conference examined, in the form of panel discussions, three topics regarding various aspects of the global experience with the CISG: the interpretation and application of the CISG beyond the contract of sale and as a model for domestic legislation ; how the CISG would look if it were drafted today ; and the interplay between the CISG and other contract law instruments. Two papers presented at the Conference can also be found in the book in a revised form. The book is intended for practising lawyers, in-house counsel, arbitration practitioners, academics, and companies coming from or doing business in the CEE/SEE region. The co-organization of the Conference and publication of this book confirms and strengthens the long lasting ties between the University of Zagreb, Faculty of Law with the UN and especially with the work of UNCITRAL.
