Importance of Equality Data Collection in Measuring and Quantifying the Extent of Discrimination and Inequality in Croatia
The right to equality and the principle of non- discrimination are enshrined in the Croatian legal order. The right to equality not only comprises equality before the law and the right to be equally protected by the state but also means to be equally able to participate in and have equal access to all fields of society. The principle of non-discrimination explicitly prohibits the exclusion of certain groups (e.g. ethnic minorities, sexual minorities, persons with disabilities, women) from particular areas such as education, labour market or access to services. However, although different legal acts either explicitly ban discrimination or contain provisions on equality, and although antidiscrimination legislation cannot be effectively implemented without collecting equality data, equality data (understood as all types of disaggregated data used to assess the comparative situation of a specific group at risk of discrimination) are neither systematically collected by the Croatian public institutions, nor equality data collection has yet given rise to public debate. In this paper we will argue that availability of appropriate equality data is a precondition for planning appropriate measures and adopting policies for vulnerable groups and implementing an effective antidiscrimination policy. The paper will proceed in three parts: in the theoretical part it will elaborate on the importance of equality data collection and on different methodologies and sources used in the collection of thereof. The second part will offer an overview of existing national l legislative or policy measures pertaining to data collection, in order to detect still existent deficiencies in legislation that should be addressed by the legislator. Finally, the third part will offer policy proposals for a more effective antidiscrimination policy by identify avenues for further policy development that will involve the collection of equality data.
