Evidence and the Principle of Proportionality. How to Get Rid of Expensive and Time-consuming Evidence?
In this text I will briefly outline some specific features of the style of civil procedure in selected countries of the European South and East that differ greatly from the values of ‘acceleration’ and ‘simplification’ proclaimed at the EU level. I will submit that some elements of the European acquis on civil procedure do contain the seeds of a uniform approach to evidence, which may have a certain horizontal effect of making the judicial practices and reforms of national legislation that regulate court proceedings in civil and commercial matters similar. A few provisions on evidence-taking from recent civil procedure reforms in Croatia will be used as an example of a new approach in evidence-taking.
