Local Citizenship in the Croatian-Slavonian Legal Area in the First Yugoslavia (1918-1941): Breakdown of a Concept?

The chapter deals with the concept of local citizenship on Croatian-Slavonian legal area in the first Yugoslav state in the period from 1918 until 1941. In the beginning the author elaborates thesis about local citizenship as an important element of Croatian legal identity established before 1918. As key features of the concept, the author specifically highlights proving of national citizenship via local citizenship certificate, relatively closed access to local citizenship for newcomers, and local citizenship as a basis of rights in a municipality but also in Croatia- Slavonia. In addition, the author highlights changes in the regulation of local citizenship done by Yugoslav central authorities. Here the author points out that local citizenship ceased to be decisive for proving of national citizenship, that new Yugoslav regulations about local citizenship of 1933 and 1934 significantly eased acquisition of local citizenship and that central authorities until 1939 succeeded in reduction of importance of local citizenship as a basis of rights. While he clearly traces changes in the legal system, the author also illustrates some limits and contrary tendencies to these changes. In this way the author demonstrates limitations of legal instrumentalism in creating new legal order.
