The 24-Mile Archaeological Zone : Abandoned or Confirmed?
The paper re-examines the issue of the archaeological zone as a jurisdictional zone distinct from the coastal State’s contiguous zone. First, the legal situation based on Article 303(2) of the 1982 United Nations Law of the Sea Convention is assessed, taking into account the State practice in the period after the adoption of the Convention. In a second part, the paper analyses the legal consequences of Article 8 of the 2001 UNESCO Convention on the Protection of the Underwater Cultural Heritage, which concerns the protection of submerged cultural objects on the seabed beneath the contiguous zone, and to what extent the new Convention confirmed or changed the legal situation in respect of the coastal State’s jurisdiction over the underwater cultural heritage located on the seabed up to the 24-mile limit. In that respect, recent State practice, as far as accessible, is also considered.
