Hague Abduction Convention: The Case of X v. Latvia
The presentation concerns a case decided by the Grand Chamber of the European Court of Human Rights. The case became famous for its very tight decision (9 to 8 judges) holding that there was a violation of Article 8 of the European Convention of Human Rights because the Latvian national court ordering the return of the child to Australia did not sufficiently address concerns in the psichological report nor whether it was possible for the mother to follow her daughter to Australia and to maintain contact with her.
