The European Convention on Human Rights does not expressly protect the environment. At the time of the drafting of the Convention, the environment was not one of the values that it was intended to be protected. However, the Convention has always been considered as an instrument capable of adapting itself to new developments. The adaptation and extension of the Convention has been effected through the interpretation of its provisions by the European Court of Human Rights in the light of changing conditions of life and the prevailing conceptions and values in democratic society. This is a reflection of the growing recognition of the importance of environmental issues that are increasingly appearing in cases brought by applicants to European Court. Therefore, the focus in this paper is on the right that has been extended to encompass environmental values namely the right to access to a court.
