Some Remarks on the Role of Meta-Juridical Sanctions in the Protection of International Legal Norms - Can Morality Protect Law?
The article deals with the relation between international law and morality, particularly on the level of their secondary norms containing sanctions. Due to the interference of these normative systems in protecting often the same values, international law can sometimes rely upon international morality to ensure efficacy of its legal norms, particularly when international legal order is not able to do it. However, international morality will react against the wrongdoer who has breached international law only provided that the same wrongdoer has violated international moral norm as well.
