Storage, Processing and Preservation of Data Obtained by DNA Analysis in Criminal Databases

Even though there is consensus regarding the admissibility of taking biological material samples from an individual for purposes of DNA analysis, the storage, processing and preservation of such data still creates controversy. Subject matter of this paper deals with open questions regarding storage, processing and preservation of data obtained by DNA analysis. Verdict reached by the European Court for Human Rights “S.et Marper v. The United Kingdom Nr. 30562/04 end 30566/04” which is focusing on certain limitations regarding storage, processing and preservation of such data shows the seriousness of the question. Besides introduction and conclusion, this paper is divided into three parts. The first part deals with data obtained by DNA analysis. Second part deals with criminal databases, while the third part focuses on taking, preservation and usage of data within criminal databases.
