SCOPE OF LEGISLATIVE REGULATION IN PROTECTION OF SENSITIVE AREAS IN THE REPUBLIC OF CROATIA
The entire territory of the Republic of Croatia has been declared as sensitive area due to belonging to the Danube and Adriatic Sea basins. The Ordinance on limit values of waste water emission provides a simple way of determining of the required level, or efficiency of treatment, for each settlement or agglomeration, on the basis of biological load, PE and prescribed sensitivity of the area. These effluent standards do not consider the receiving capacity of the final recipient, and the above-mentioned Regulations and other legislation are not concerned with the influence and control of non-point sources of pollution that may exert decisive impact on the status of the recipient. The paper analyzes, from several standpoints, the present legislative regulation applied in the Republic of Croatia and its scope in protection of sensitive areas. It will demonstrate that strict application of existing legal solutions cannot meet, in each case, the final objective of water management, which leads to application of recipient standards with respecting of point and non-point sources of pollution.
