Works councils in Croatia : a form of the protection of worker's rights and/or the employer's interest?
A two-tier system of worker participation in Croatia seems to have mitigated the negative attitude towards the works councils, primarily because of the explicit prerogatives exclusively conferred to trade unions that therefore have no reason to feel directly threatened. The condition was probably alleviated by the need to meet European standards, but also by the role of the European Works Councils, which were introduced into the Croatian labour legislation in the process of harmonisation with the acquis communautaire and European Works Council Directive 94/95/EC and Council Directive 2006/109/EC, and now through the provisions of the new Labour Act which entered into force in 2009. Of course, the application of these provisions is deferred until full membership in July 2013, and hence estimation of their effects is not possible at this time.
