In the Classroom and the Courtroom
_ e law of the European Union created a new situation and started to erode structures of traditional thinking about law. _ e question emerged whether the understanding of law will be transformed or merely reconstructed according to the traditional paradigm.1 _ e transformation can be described in terms of four interrelated Reorientations that, in my opinion, any European lawyer, professor, judge and or attorney, needs to be aware of. _ is is not to say that any of them will be relevant for developing a legal argument or deciding a given case but, that a European lawyer should bear them in mind when thinking about important issues of European Union law. _ e four Reorientations are: – Reorientation from rational to reasonable ; – Reorientation from object-dominated to subject-aware ; – Reorientation from descriptive to functional ; – Reorientation from authoritative to argumentative.
