Expedited Arbitration Proceedings - About Some Croatian Experiences

Compared to the courts of law the adventages of arbitration tribunals such as fast decision making, simplicity and effectiveness have been brought into question by a number of circurmstances in wich it is carried out. In creasing complexity of international trading, changes in expectations of the parties related to the aim and purpose of the arbitration, time-consuming establishing of arbitration tribunals, unavailability of same arbitrators, numerous summons and related costs of arbitration proceedings require reconsideration of the current arbitration practices and search of the new solution. Can the listed disadvantages be done away with by special rules on fast track and simplified arbitration proceedings, should arbitration institutions establish such rules, will the possibility of their application be comprised in general rules or should there be a set of special rules, what sholud they comprise and in wich arbitration proceedings can they be applied ; all these issues will depend on the decision made by the individual arbitration institution. However, in spite of differences indicated by the comparative analysis of the mentioned rules it is the same reference-to speed up the arbitration proceeding, keep the arbitration proceedings quality and make then more effective.
