Multilingual Lawmaking in the EU under Attack

This presentation deals with the paradox of EU multilingualism and the problem of legal uncertainty in EU multilingual legislation. Theoretically, the 27 equally authentic texts of EU legislation are presumed to have the same meaning ; however, in reality they are plagued with inevitable divergences, thus denying Union citizens their right to legal certainty. This problem has become particularly acute with the EU’s application to accede to the European Court of Human Rights, which upholds citizens’ right to foresee the effects of an action in law on the basis of their own language version of a disputed provision. In fact, the EU policy of multilingualism based on language equality is now at stake. The author discusses the merits of current proposals to reform the current linguistic regime by introducing a three-language model, a two-language model or a one-language model, the latter of which would make English the only authentic version of EU legislation.
