Negative Scope of the EU Freedom of Establishment against National Borders
Freedom of establishment encompasses participation on stable and continuous basis in economic life of a Member States, other than the state of origin and to profit there from, as well as access or exercise of activities of self-employed persons under the same conditions as nationals in Member State of establishment. Next to the detailed elaboration of the scope of the freedom of establishment, the presentation elaborates the negative scope of this freedom and its connection with national borders of EU Member States while fulfilling the obligation of granting free establishment on their territory. The exception clause which concerns the activities which are connected, even occasionally, with the exercise of official authority is elaborated through the relevant provisions, case law, and practical examples in order to be defined as precisely as it is possible. The special concern has been taken towards the relevant legal framework and legal practice in Croatia as the candidate state.
