The Croatian Parliament adopts the Annual Report of the Croatian Competition Agency for 2009

The Annual Report of the Croatian Competition Agency for 2009 summarizes activities of the Agency in the reporting period. It reports both on antitrust and state aid aspects of its enforcement record but also deals with advocacy efforts of the Agency and the new legislative framework that was adopted in 2009 (entered into force in October 2010). It also covers the cooperation of the Agency with sectoral regulators as well as international cooperation. The most important event in 2009 for the Agency was the adoption of the new Competition Act by the Croatian Parliament on 24 June 2009. The new Act thoroughly reforms domestic competition rules bringing them in full compliance with the acquis. Its main feature is the newly acquired power of the Agency to directly fine undertakings for breach of competition rules. This change is expected to increase the effectiveness of competition enforcement in Croatia. Under the old system the Agency had no power to decide on fines - after establishing an infringement the Agency had to request from a locally competent misdemeanours court to decide on the fine. As regards its antitrust enforcement record in 2009 the Agency focused on detecting cartel agreements which resulted in several prohibition decisions (driving schools, building caretaker services). In the area of vertical agreements it mostly dealt with restrictive arrangements in the motor vehicle sector. The most important decision in the area of the abuse of dominance was the HDS- ZAMP case where collecting society imposed dissimilar conditions to equivalent transactions within the framework of its private copying remuneration scheme. In the area of merger control the most important decision was the INA/MOL case (Phase II assessment - conditional approval). The Agency was also busy in analysing different markets (postal and courier services, milk and milk products, office supplies, retail industry etc.).
