Golf-tourism: Social and Economic Factor of Innovation and the Development of Istrian Tourism and a Legal Problem of the Croatian Law

The paper deals with the notion of golf-tourism from the multidisciplinary point of view: as an economic factor of innovation and development of the Istrian region as well as a legal problem of the Croatian law. Golf-tourism in Istria leads to diversification and enhancement of a destination’s aggregate tourist offer. Negative effects are evident in relation to numerous planned golf courses, what may create the risk that golf-tourism becomes, contrary to the principles of sustainability and indigenousness of the destination, the explicit form of tourism in Istria. Golf-tourism is a twofold legal problem in the Croatian law: 1) Croatian legislation does not deal with golf-tourism at all, 2) due to ''public interest'' and the development of golf-tourism, the controversial Golf Courses Act was adopted (in force since 02.01.2009), it even permits the expropriation of private land in favour of a third party. The conclusion is that it is necessary to perform an optimal combination of different forms of tourism in Istria today, whilst Croatian law requires a higher degree of golf-tourism legal regulation and a revision of dubious provisions from the Golf Courses Act.
