Protection of Cultural Property in Non-International Armed Conflict
As different sets of international legal rules regarding armed conflicts of both a non-international and international character have been developing from the 16th century until today, it is sometimes not clear which rules protect cultural property in which kind of conflict. This article analyses the development of the rules protecting cultural property in the event of non-international armed conflict and how these rules differ from those regulating the protection of cultural property in the event of international armed conflict. Particular attention is given to the most important international legal instruments regarding these issues. The applicable law and practice of international tribunals such as the International Tribunal for Former Yugoslavia (ICTY) and the International Criminal Court (ICC) is presented, as well as the major strengths and weaknesses of the contemporary international legal system for the protection of cultural property in the event of non-international armed conflict.
