Competition Law in Croatia - A Brief introduction to the New Legislation
The Act for protection of market competition entered into force in 1995. This Act has established a basis for assessment of restrictive effects of certain types of agreements, but also the beneficial effects of agreements on the competition on the relevant market. Such approach to the restrictive agreements is entirely in accordance with the rule of reason approach of the United States Courts and system of group exemptions in the European Community competition law. The Act separatly regulate special responsibility of undertakings having dominant position on the market for abuse of such position in a way detrimental to the other undertakings on the relevant market.The Croatian legislation regulates also the control of mergers and takeovers of companies, namely concentrations on the market. The key role for enforcement of competition law in Croatia has been vested to the Agency for Protection of Market Competition.
