(In)Surpassable Barriers to Lustration: Quis custodiet ipsos custodes?
Lustration is in many aspects connected to certain legal procedures. However, there are a number of legal barriers that bar the success of this process. Some of them are procedural (e.g. statute of limitations), and some of them organizational – e.g. the legitimacy of those who are supposed to be the implementors of the lustration practices. In relation to judicial practices, the particular situation of Croatia points to very weak chances that a judiciary that is itself arising from an intransparent process of appointment be an appropriate tool for a sensible lustration practice. On the other hand, lustration in the judiciary appears now not only as belated, but also as highly improbable.
