Sažetak
The paper examines the impact of state transformation (succession, merger) on the validity of arbitral clauses that provided arbitration administered by institutions that operated within sponsoring organizations that were transformed or abolished. In the first part, theories on the function of arbitration institutions are presented, as well as main features of institutional arbitration in former socialist countries. After that, succession cases, involving arbitral institutions from former countries: Soviet Union, Czechoslova-kia, DDR and Yugoslavia are outlined. Finally, the author presents possible approaches to succession cases and proposes solutions to them.
