A critical review is presented of the provisions of the new Croatian penal legislatude and Act on the Protection of Persons with Mental Disorders relevant for psychiatric practice, and the practical implementation of these laws which became operative in the Republic of Croatia in January 1, 1998. The very text of the acts revelals some major problems, i.e.: - abscense of clear criteria for precise quantification accountability has been abolished in the new Penal Code ; - insufficient differntiation between the category of patients admitted to hospital "without consent", patients hospitalized for a high level of threat to their environment of themselves and patients admitted as forensic patients who effectuated the caracteristics of a criminal act in the state of inaccountability - a fialure to carry out the security measure of compulsory psychiatric treatment because there is still no institution on the Republic of Croatia in wich this measure could be carried out. Beside describing the major difficulties in the implementation of the new Croatian psychiatric legislature, a series of suggestions to overcome them promptly and properly are offered.
