Interference with Navigation: Modern Challenges - Concluding Remarks

The author had the task to sum up the conclusions of the Symposium on "Interference with Navigation: Modern Challenges", which was held at the International Tribunal for the Law of the Sea in Hamburg, Germany, on 15 March 2003. The proceedings of the Symposium were published in a special issue of the International Journal of Marine and Coastal Law. In his concluding remarks the author refers to the work of the Third United Nations Conference on the Law of the Sea, notably the way in which navigation was treated at the Conference. He takes the view that in this treatment lay some of the shortcomings that open the doors for the problems concerning navigation that we face today, and elaborates on some of the LOS Convention's vague provisions, such as the nationality of ships, the right of warships to innocent passage through the territorial waters of third states, and the navigation of foreign ships in the exclusive economic zone.
