Arbitration Under Bilateral Treaties on Promotion and Protection of Investments Concluded Between Croatia and Other States
In recent years the Republic of Croatia has concluded various bilateral conventions on promotion and protection of foreign investments with interested states. Those conventions regulate the legal regime of investments in the contracting states and such conventional solutions have priority over the internal national regulations. The author outlines the conventional scopes of application ratione personae and ratione temporis and, in particular, the arbitral provisions of these bilateral treaties. Such provisions often point to the jurisdiction of the ICSID under 1965 Washington Convention on Settlement of Investment Disputes between States and Nationals of other States.
