Mutual Trust, Mutual Recognition and the Rule of Law in Croatia
In this report, we discuss the role of EU law in enforcing the rule of law in Croatia. We note that the impact of EU law in that respect can be considered as marginal, at least so far. Such an impact may become more visible prospectively, however. For example, in case something similar to the rule of law ‘backsliding’ would happen in Croatia, the argument would be that the EU has at its disposal certain legal and policy tools that could address those issues. In reality, however, although it has many institutional and structural characteristics like other post-socialist Member States that saw the rise of authoritarian illiberal parties that captured state institutions and were in the focus of the rule of law crisis in the EU, Croatia has not yet reached those extremes. Which is not to say that many concerns do not remain, including those related to the independence of judiciary, systemic corruption, autonomy of universities, free speech, media freedoms, minority rights, etc.
