Intellectual Property Protection with Special Emphasis on Copyright Protection

Numerous scientists and experts from different fields have been dealing with the issue of intellectual property on a theoretical level, but the topic is of practical importance as well. This paper deals with the conceptual definition of intellectual property, with a special emphasis on copyright. The aim of the paper is to point out the current solutions of positive legislation in terms of intellectual property protection, especially authors’ copyright protection during their employment, as well as other work-related relationships (service contracts, etc.). Based on the carried out research, the authors have concluded that the current legislation does not provide authors with good enough protection when it comes to financial compensation, which consequently adversely affects motivation and stimulation of intellectual creativity. In practice, we are often faced with the following issues: who is the author of the copyrighted work and what are the rights and obligations of employees, and what are the rights and obligations of employers. In trying to provide answers to these questions, the authors shall use both the normative and comparative methods. This paper will compare the legal systems of Croatia, Germany and Slovenia and the ways these countries have regulated copyright issues during one’s employment
