Protection of the environment in the Constitution of the Republic of Croatia
The author will analyze the Croatian constitutional framework for protection the environment. The paper will show that, although not explicitly, the right to a healthy environment is protected under the Constitution as the right to a healthy life which is an expression of a broader right to a healthy environment. Croatian Constitution does not contain many provisions which relate to the environmental protection. Moreover, important principles like sustainable development and “polluter pays” are not even mentioned in the Constitution. However, the devotion of the State to sustainable development was expressed by the Parliament as early as 1993 and the legislature prescribes those principles. There is, therefore, room for improvement regarding the constitutional protection of future generations and the environment, so the paper will give several suggestions de lege ferenda on possible desirable constitutional changes.
