Overriding Mandatory Provisions before the CJEU: Takeaways or Getaways?
Overriding mandatory rules in EU private international law have been regulated since the entering into force of the 1980 Rome Convention on the law applicable to contractual obligations. As the Rome I Regulation and the Rome II Regulation were enacted the Court of Justice was given the opportunity to provide its interpretations in five cases. In this paper, the cases are horizontally analysed to provide a systematic insight into the current state of the law.
