INSPEKCIJSKI NADZOR RADNIH UVJETA POMORACA PREMA MLC KONVENCIJI U LUKAMA DRŽAVA PARIŠKOG MEMORANDUMA

The Maritime Labour Convention, MLC 2006, entered into force in 2013. It represents the consolidation and modernization of the standards set in 37 conventions previously adopted by the ILO. Almost all aspects of seafarers’ life and work are set out by the MLC. All Member State ships shall have a maritime labour certificate as prima facie evidence that the requirements of this Convention have been met. The most important provisions of the Convention which allow seafarers to exercise their rights efficiently are those that provide protection against the financial consequences of work-related sickness, injury or death through a financial guarantee institute. The first set of Amendments to MLC were adopted in 2014 with the aim of further improving seafarers’ standard of working conditions with precise provisions on financial guarantee (compulsory insurance). These new provisions provided protection of abandoned seafarers for the first-time. Other amendments followed in 2016, and the latest in 2018, which shall come into effect by the end of 2020. The inspection of foreign ships in EU state ports is managed in accordance with provisions of The Paris Memorandum of Understanding on Port State Control (Paris MOU), which was adopted in 1982, and has since been altered and amended many times. All states signatories of the Paris MOU (27 states including the Republic of Croatia) have pledged to maintain effective inspection system of ships calling at their ports, in order to enable all ships, without discrimination as to flag, to comply with the standards of numerous international conventions on navigation safety, protection of marine environment, as well as the standards of seafarers’ working and living conditions.The paper analyzes the inspection system of ships in ports of the states signatories of Paris Memorandum with regard to reducing deficiencies in working conditions of seafarers. There is also a presentation of statistical data on types and number of deficiencies on ships related to non-compliance with the MLC Convention, as well as their share in all deficiencies identified by inspections of foreign ships in the ports of states signatories of Paris Memorandum during the 5-year period from 2014 to 2019.
