Sažetak
The aim of the paper is to analyse the extent to which the Croatian regulation on forced migration (legislation and policy documents) is grounded in evidence, building on empirical data drawn from the preparatory processes and draft proposals of legislation, process of public consultations, parliamentary discussions, and policy studies and reports of different actors, respectively. By that, the paper will also provide a deeper insight into the development of migration regulation, from the agenda-setting to adoption of the regulation. As a result of the research, the possibilities for improvements in migration policy making through the use of evidence-based policy making techniques and other better policy instruments will be discussed. The question of the development of migration regulation is becoming more important taking into account the intensified securitisation of migration policies after 2015 mass migrations. This notion, encompassed with the ‘national turn’ in migration governance, is visible throughout the EU, including CEE countries in which very often apart from the objective reality of country’s exposure to forced migrations. Also, weak analytical administrative capacities for policy making represent a significant problem in CEE countries such as Croatia. Therefore, it is assumed that the regulation is rarely based upon the research evidence, but mainly upon the pressures stemming from the external agencies and institutions (in this case the EU institutions and policies), as well as from the internal political, administrative and societal actors (such as populist political parties, key ministries, and local civil society organisations), and policy traditions. This is especially the case in ‘wicked’ policy problems such as migrations, in which there are limits to evidence-based policy making because evidence can be highly disputed by policy makers. At the same time, ‘better regulation policy’ is highly promoted and expected by the EU in different policy areas, including migration governance.
