International Jurisdiction for Violations of Data Protection
Along with the controversy surrounding the enactment of the General Data Protection Regulation, international jurisdiction for proceedings instituted by data subjects as a result of unlawful processing emerged as an issue attracting increasing scholarly attention. The paper analyses the relevant provisions of the GDPR and provision of the Brussels I bis Regulation applicable in data violation cases which derive from non-contractual relationship and their interrelation. Against this background, the author inspects the applicability of existing CJEU’s case-law interpreting the relevant Brussels I bis rule.
