Some methodological issues in Neuroethics: the case of responsibility and psychopathy
There are some methodological challenges, and possible pitfalls, for neuroethics when it evaluates neuroscientific results and links them to issues such as moral or legal responsibility. We investigate them by considering the case of the responsibility of the psychopathic offender. When analysing the normative issues relevant to the responsibility of psychopathic offenders, an explicit and defended view on how to determine, and investigate, the relevant ethical and legal concepts of responsibility is needed. When interpreting the significance of neuroscientific data for responsibility, it is important to address conceptual issues about the nature of the capacities required for responsibility and determine which neuroscientific data are relevant to their presence. Moreover, inferences about the responsibility of psychopathic offenders should not be based on a selective and simplistic reading of the scientific literature.
