Republic of Kosovo - historical and legal exception
The main premise of the paper is that Kosovo is a historical and legal exception ; an international specificum that needs to be analyzed in the context of unfinished territorial fragmentation of the post communist space, namely as a consequence of Yugoslav demise in 1991. In order to present the legal and regional security framework for the contemporary international relations debate over Kosovo the nature of complex Serb-Albanian relations since 1945 has to be examined. After taking into account both historical and legal developments that led to Kosovo independence - the 1974 Constitution of Yugoslavia and the 1244 UN Resolution, it will be further argued that Kosovo independence is an example where international law necessarily needs to be flexible in order to stabilize the region.
