Komparativni prikaz nove reforme krivičnih dela protiv časti i ugleda u krivičnom zakonodavstvu Srbije i Hrvatske

Crimes against honor and reputation in the criminal legislation of Serbia and Croatia have undergone several reforms in the last two decades. In the Republic of Croatia, the reform of these offenses began as early as 1997, immediately after the passage of the Criminal Code, when several possible solutions for the protection of honor and reputation were pointed out. There were proposals that offenses against honor and reputation have different prescribed incriminations and penalties, and that these offenses should be prescribed only as misdemeanors, to the point that they would be the only object of protection in civil proceedings. A major reform followed in 2011, with the adoption of a new Criminal Code modeled on Swiss Criminal Law. However, these changes did not survive as they were not practicable in practice, so there are new amendments to the 2015 offenses against honor and reputation, which remain in force until 2019 when the crime of Grave Shame is decriminalized. Unlike the Republic of Croatia, the Republic of Serbia abolished the criminal offense of Defamation by the Criminal Code Amendment Act 2012 because of the pressure of professional publics and journalistic associations, so that the RS Criminal Code knows two offenses against honor and reputation: Insult and Taking out Personal and Family Circumstances.The paper provides a comparative overview of crimes committed against the Honor and Reputation according to Criminal Code of the Republic Serbia and Croatia.
