The Liability Aspects of GDPR in Commercial Contracts
Obligations imposed by the new European Union’s General Data Protection Regulation (“GDPR”), since May 2018 when it became enforceable as the primary basis for data protection law in the European Economic Area (EEA), include potential financial exposure in B2B relations. The commercial contracts are by their inherent legal nature capable of being a source of GDPR compliance requirements. GDPR gives data subjects the right to receive compensation if they have suffered material or non-material damage as a result of a compliance infringement and gives to the national supervisory authorities’ capability to levy fines. This paper analyses are the liability limits of GDPR obligations imposed on contractual parties in commercial contracts. The primary research question that this paper labour to produce is the adequacy of GDPR general liability rules for commercial contracts.
