LEGAL CHALLENGES OF THE REGULATION AND IMPLEMENTATION OF THE ONE-STOP SHOP INSTITUTE AS A MODEL OF MULTI-LEVEL AND INTEGRATED PUBLIC ADMINISTRATION AND ITS IMPACT ON THE EFFICIENCY OF THE STATE ADMINISTRATION

European administrative procedural law has been frequently modified. Due to numerous changes, traditional concepts in the administrative law have been replaced. This is especially evident in transitional countries where changes occur through the reforms of public administration including processes of Europeanisation and harmonisation. Moreover, in these countries there is a tendency of continuous and dynamic growth for the purposes of joining the EU realised by implementing the EU Law. In addition, the mentioned changes refer to enhancing capacities for the future application and transposition of numerous procedural law instruments. Content for the regulation of the administrative procedure in Croatia had to be redefined so it reflects the European administrative-procedural standards and examples of good practice. The focus of the paper is therefore placed on the analysis of the (European) influence and on the modification of the administrative procedure from the administrative-legal aspect. The emphasis is put on establishing Points of Single Contact also called the one-stop-shop principle. The Institute of the one-stop shop was introduced through the 2009 Croatian General Administrative Procedure Act. The Institute, which is one of the most significant institutes in administrative proceedings, was implemented into the Croatian administrative procedure to fulfill the conditions proposed by the 2006 Directive on Services in the Internal EU Market. It was suggested to enhance collaboration and dialogue between the citizens and administration as well as to simplify legislative administrative procedures. The importance of the Institute is in its ability to improve public administration especially communication and services for citizens. Provisions of the current General Administrative Procedure Act will be analyzed in the initial part of the paper. The analyzed provisions regulate the Institute of the One- stop shop while pointing out the reference to the European Union Treaties, the Directive on Services in the Internal EU Market and Charter of Fundamental Rights of the European Union. Furthermore, the advantages of applying the one- stop-shop principle will be presented along with the implications of applying it in practise. A short review regarding its purposeful use will also be provided. One of the key priorities of the Government of the Republic of Croatia is to digitalize the public administration. The Institute is also viewed as one of the instruments contributing to better public administration efficiency by reducing administrative barriers, accelerating procedures, offering a wider range of e- services and increasing the level of quality of public services. The European concept of multi- level administration includes cooperation and communication which are crucial when organizing one-stop-shops. The result of applying the concept should be integrated public administration and services which are rather challenging to achieve. Moreover, examples of good practice in state administration realized through collaboration between the Republic of Croatia and Hungary (CATCH project) in the period from June 1st to September 30th, 2018, will be presented with the aim of providing quality services to local citizens. Three county public administration offices active in the program area took part in the project: the government office of Šomođska county (Hungary) as the main beneficiary and two project partners: the state administration office in Međimurska county (Croatia) and the state administration office in Osječko-baranjska county (Croatia). The author will point out the advantages of the collaboration regarding administrative procedures of the border area with the aim of simplifying the proceedings, especially the most important areas perceived as a positive example of Croatian and Hungarian public administration (Government Windows). Considerations regarding the current state will be presented conclusively along with the possible improvement suggestions and examples from the Hungarian model of the one-stop-shop which should be used as guidelines for improvement of our own system.
