Development of asylum legislation in Croatia: evidence-based policy making or EU top-down pressure
The aim of this presentation is to analyze whether the asylum legislation in Croatia has been developed only as a result of Croatia’s accession to the EU, or at least in some occasions, the legislation and policy documents were developed taking into account scientific knowledge and/or other data available to policy- makers. Both at the European and at the Member State level, evidence-based lawmaking is on the rise. EU promotes better and smart regulation policy, which has been equated with tools to improve the preparation of new regulations, which also includes the application of informed (evidence‐ based) expertise to regulatory issues. Smart regulation includes several instruments that should improve regulation, such as simplification, regulatory impact assessment, public consultations, ex-post evaluation of legislation, improving the implementation, and making legislation clearer and more accessible.
