In all cases concerning the children, the principle of best interests of the child must be of the primary consideration in all actions or decisions, regardless to their citizenship and residence status. Common European Asylum System exists of many provisions promoting the special protection of the best interest of the unaccompanied children who are seeking or are granted international protection. Regardless to the existence of the application for the international protection, the state authorities have at their disposal the private international law protection mechanisms. The aim of this paper is to describe the interrelation of the European asylum law and private international law concerning the protection of rights of unaccompanied minors. The main hypostasis of this paper is that the application of the rules of private international law in the procedures which include the unaccompanied minors will contribute to their protection.
