Hyperlinking to copyright works: Is there a link rot?

Information Society Directive has been under particular scrutiny of the Court of Justice of the EU in the past five years due to many questions which have arisen in relation to hyperlinking to the webpage containing work protected by copyright. From the judgment in Svensson (C-466/12) to the judgment in GS Media (C-160/15), the CJEU interpreted the notion of "communication to the public" in situations of hyperlinking of the copyright work. Each of these judgments presents a piece in the puzzle which has to be linked up to other pieces to see the big picture. This paper provide the insight into the architecture of the system and inquires into weak or possibly missing links.
