Implementation of the Environmental Impact Assessment and the Appropriate Assessment in Marina Developments from the Viewpoint of the Newest EU Member State
This article examines how the environmental impact assessment (EIA) pursuant to the EIA Directive and appropriate assessment pursuant to the Habitats Directive are applied to marina development in the newest EU Member State, Croatia. The analysis focuses on the screening procedures to determine whether or not to carry out an EIA and the prior assessment to ascertain whether a marina development is likely to have a significant impact on the Natura 2000 ecological network. The findings of the analysis are evaluated by comparison with the relevant case law of the Court of Justice of the European Union. The article argues in favour of the implementation of the EIA and the appropriate assessment which can bring benefits for the marine environment in Croatia.
