CONCESSION ON CROATIAN HIGHWAY AND DIRECTIVE 2014/23EU ON THE AWARD OF CONCESSION CONTRACTS
This paper presents the essential elements for awarding a concession ; beginning with the Adriatic-Ionian highway as a preliminary issue, and a Three-year plan on awarding concessions in the Republic of Croatia. As well as key ingredients for the preparation of the concession on the highway in Croatia. Also the question of Transport Development Strategy, which currently does not exist, and possibile options on how to resolve operational risks, and to whom the burden upon the termination of the concession agreement lays on. In conclusion, it elaborates on the crucial questions of 'de lege lata', in comparison with successful and less successful models and it will show how the situation might look like if we wish it to be profitable for future generations and not only for Croatia but also countries throughout the region. Therefore, explains the much broader issue which goes beyond the borders of the Republic of Croatia because all the countries in the region where the Adriatic-Ionian highway passes will have much greater benefit than shown. At a time of pressing demands for efficient spending of public money EU Directive will facilitate the conclusion of concessions and therefore of public-private partnerships (PPP), encouraging new investments, promoting a quicker return to sustainable economic growth and contributing to innovation and long-term structural development of infrastructures and services.
